These Terms of Reference ("Terms") govern the provision of Swahili interpreting services by SwahiliAusi ("Service Provider") to clients ("Client"). By booking and using our services, you agree to be bound by these Terms.
2. Service Description
SwahiliAusi provides professional NAATI-certified Swahili interpreting services in the following modes:
- On-site (face-to-face) interpreting
- Telephone interpreting
- Video conference interpreting (Zoom, Microsoft Teams, WebEx)
Services are available across multiple sectors including medical, legal, community, education, insurance, and corporate settings.
3. Booking and Confirmation
- All bookings must be made through our online booking form or by phone
- Minimum booking duration is 15 minutes
- Confirmation will be provided within 2 business hours of booking
- Clients are responsible for providing accurate appointment details
4. Payment Terms
- Payment terms will be discussed and agreed upon at time of booking
- Invoices are issued following service delivery
- Payment is due within 30 days of invoice date
- All fees are in Australian dollars
5. Cancellation and Rescheduling
- Cancellations made 48 hours prior to appointment are free of charge
- Cancellations made less than 48 hours prior may incur a 50% cancellation fee
- No-shows will be charged in full
- Rescheduling requests must be made as soon as possible
6. Confidentiality and Privacy
- All information disclosed during interpreting sessions is strictly confidential
- The Service Provider adheres to the Australian Interpreter Code of Ethics
- Client information will not be shared with third parties except as required by law
- Security protocols exceed requirements for medical and legal settings
- Service Provider is police check cleared
7. Professional Standards
- All services are provided by a NAATI-certified interpreter
- The Service Provider maintains impartiality and neutrality
- Services are provided in accordance with professional interpreting standards
- The Service Provider will not provide legal or medical advice
- Accurate and faithful interpretation is guaranteed
8. Client Responsibilities
- Clients must provide relevant context and background information before the appointment
- Clients must inform the interpreter of any specific terminology or requirements in advance
- Clients are responsible for ensuring all parties are present at the scheduled time
- Clients must respect the interpreter's professional boundaries
9. Liability and Limitations
While the Service Provider commits to providing accurate and professional interpreting services, the following limitations apply:
- The Service Provider is not liable for misunderstandings arising from unclear communication by any party
- The Service Provider is not responsible for decisions or outcomes resulting from the interpreted communication
- The Service Provider's liability is limited to the fee charged for the service
- The Service Provider is not liable for delays caused by circumstances beyond reasonable control
10. Recordings and Documentation
- Recording of interpreting sessions requires prior written consent
- The Service Provider may take notes during the appointment for quality assurance
- Any recordings or notes will be kept confidential and secure
11. Technical Issues
For video or telephone interpreting:
- Clients are responsible for ensuring reliable internet/phone connection
- The Service Provider will attempt to reconnect in case of technical issues
- If the connection cannot be restored, the session may be rescheduled or refunded
12. Changes to Terms
SwahiliAusi reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Continued use of our services indicates acceptance of any modifications.
13. Dispute Resolution
Any disputes arising from these Terms shall be resolved through:
- Good faith negotiation between the parties
- Mediation if negotiation fails
- Legal proceedings as a last resort
14. Governing Law
